1. Scope

These terms govern the use of the "Body Fat Scanner" app and this website of Aithentica GmbH.

2. Service description

The app provides an estimate of body fat percentage based on photos, plus progress-tracking features. The app is not a medical device and does not replace medical advice or diagnosis. Uninterrupted, error-free operation is not guaranteed.

3. Conclusion of contract

The user agreement is formed by downloading and setting up or registering in the app.

4. Rights of use and obligations

You receive a simple, non-transferable right to private, non-commercial use. You agree to comply with applicable law, not to upload infringing content, and to keep your login credentials confidential.

5. Pricing and payment

Basic features are free. Paid features are indicated in the app; billing is handled via the payment systems of the Apple App Store or Google Play Store.

6. Right of withdrawal

Consumers have a 14-day right of withdrawal. For digital content/services, this right expires once performance has begun with your express consent and your acknowledgement that you thereby lose the right of withdrawal.

7. Liability and health notice

We are liable without limitation for intent and gross negligence and for breach of essential contractual obligations; otherwise liability is limited as permitted by law. Health notice: the app provides estimates for information and motivation and does not replace medical advice.

8. Data protection

Information on the processing of personal data is available in the privacy policy.

9. Changes

We may adjust these terms with reasonable prior notice, e.g. due to legal changes or new features.

10. Term and termination

You can delete your account at any time in the app settings. Paid subscriptions are cancelled via the respective app store.

11. Governing law

Austrian law applies, excluding its conflict-of-law rules. Mandatory consumer protection provisions of your country of residence remain unaffected. Should any provision be invalid, the validity of the remaining provisions is unaffected.
